Code Compliance Panel

In March 2007, PhonepayPlus (then ICSTIS) proposed a greater level of separation between the Board and the Adjudication Panel to enable the Board to focus on its strategic business and ensure increased efficiency and consistency in adjudications. On 28 March 2008, Ofcom approved amendments to the PhonepayPlus Code of Practice to allow the creation of the new Code Compliance Panel (CCP), which came into effect on 28 April 2008.

The Code Compliance Panel is responsible for PhonepayPlus’ adjudicatory function. The CCP is made up of nine people from which three members are drawn to form PhonepayPlus’ bi-weekly Tribunals, which hear and adjudicate on cases against premium rate providers that PhonepayPlus suspects to be in breach of its Code of Practice. While three PhonepayPlus non-industry Board members sit on the CCP (Robert Chilton OBE, David Clarke and Howard Webber), the CCP's decision-making process is independent of PhonepayPlus, with the other six members (pictured below) being appointed for their specialist legal and adjudicatory experience.

  

Meet the panel

David Cockburn

 

David Cockburn
Chair

Since 2001, David has held the statutory office of Certification Officer, which in effect is the Regulator for trade unions and employer associations ( http://www.certoffice.org/ ). David is also a part time Employment Tribunal Judge, has previously been a practising partner and solicitor for many years and is an accredited Mediator. David has previously held various Chair positions, most recently Chair of the Employment Law Committee of the Law Society.  He is an experienced Chair and Adjudicator.

Emma Boothroyd

 

Emma Boothroyd
Adjudicator (legally qualified)

Emma is currently an Adjudicator with the Solicitor's Regulation Authority, deciding on issues of poor service and/or conduct relating to a complaint about solicitors. Emma has held this post since 2006. Admitted as a Solicitor in 1999, Emma is a highly experienced advocate and adjudicator. Previous experience has included acting as Barrister and Solicitor in the field of family law and Practice Standards Adviser for the Law Society.

Michelle Peters

 

Michelle Peters
Adjudicator (legally qualified)

Michelle Peters has worked as a solicitor for Clifford Chance in marketing law and intellectual property litigation. She is currently a business consultant in franchise management and is an independent Member (Adjudicator) of the Direct Marketing Commission (formerly the Direct Marketing Authority), which adjudicates on complaints about breaches of the direct marketing Code of Practice. Michelle takes the lead at sub committees where companies who have breached the Code are asked to appear.

David Jessel

 

David Jessel

David has worked for the past 6 years as Commissioner to the Criminal Cases Review Commission and has been a Member of the Advertising Advisory Committee at the ASA as well as Director of the independent television production company BFM. Prior to this he presented on Channel 4 and various BBC TV programmes including Newsweek, Out of Court and The World Today. David also carried out investigations on Channel 4's Trial and Error, Dispatches and the BBC's Rough Justice. He has won top awards in television for his career's work in investigating miscarriages of justice. In 2005 he was awarded an Honorary Doctorate of the University of England and has been honoured with the Bar Council's Special Award.

Louise Povey

Louise Povey has a background in adjudication, regulation in both public services and financial services as well as law. Louise is currently a Chair and Lay Panel Member with the Nursing and Midwifery Council where she hears complex cases concerning professional misconduct involving multiple stakeholder interests. Prior to this she undertook a career in public sector management dealing with issues of regulation for the GMC, The Legal Services Commission, The Personal Investment Authority and The Office of the Building Societies Ombudsman. Louise holds an honours degree in United States technology law, has a Berkeley Certificate in Business Administration and is currently studying for a Masters in Public Administration through the OU.

Maggie Redfearn

 

Maggie Redfern
Adjudicator (Lay)

Maggie has most recently served as an Editorial Policy Adviser at the BBC, helping to ensure that programmes, online and mobile content and other off-air activities are within the BBC's editorial guidelines and are compliant with Ofcom and other regulatory codes. 
She was a member of the Broadcasting Standards Commission, adjudicating on complaints about fairness, invasion of privacy and offence in radio and television broadcasting. In her earlier career she was for many years a radio producer, and later become a secondary school teacher, specialising in English and Media Studies. She was appointed Justice of the Peace in 2003 and sits regularly at Highbury Corner Magistrates' Court.
