PhonepayPlus statement on two adjudications by consent relating to case references 772121, 768905, 772223 and 748801

PhonepayPlus has today published two consent orders relating to four linked Tribunal cases (references 768905, 772223, 772121, and 748801) involving mBlox Limited.
During 2009 PhonepayPlus received several complaints from consumers in relation to four services operated over the mBlox content aggregation platform. These services were brought before the PhonepayPlus Tribunal as Service Provider cases and resulted in four separate adjudications against mBlox (click on link below to search our adjudication database using the above references). mBlox subsequently requested an Oral Hearing for all four cases but then decided (with Phonepayplus' consent) to proceed to a hearing with initially only one case. That case was heard on 22 October 2009 and the sanctions imposed by the original Tribunal were also imposed by the Oral Hearing Tribunal. mBlox subsequently decided to launch an appeal of that case to the Independent Appeal Body and proceed with an Oral Hearing for the remaining three cases.
PhonepayPlus has been encouraged by mBlox’s ongoing compliance activity. Working alongside our compliance advice team, it has made a significant investment in new technology, personnel and resources to aid compliance and prevent further harm occurring to consumers from services operating over its platform. mBlox has also now accepted full liability for the original breaches upheld by the Tribunal.
For those reasons PhonepayPlus has agreed to a reduced fine payment from mBlox. As set out in the consent orders (see links below) PhonepayPlus has agreed a total payment of £200,000 in relation to all four cases. PhonepayPlus has also agreed that refunds will be paid to all those who have made valid claims to mBlox up to the date of the orders, and in relation to two of the cases has agreed that the services will remain barred until they are compliant to PhonepayPlus’ satisfaction.
