What are the benefits of obtaining compliance advice?
The PhonepayPlus compliance team can help you run a compliant service.  A compliant service is mostly likely to ensure a case is not raised against you which could involve sanctions being imposed under the PhonepayPlus Code of Practice.

How long will it take?
We aim to process requests for compliance advice within 5 working days.  If a response is required quickly the Executive will endeavour to provide a faster response. 

What if I don't agree with the suggested changes?
The advice given by the Executive is purely advice; however, if you choose to ignore advice given by the Executive and your service is investigated the Board will take this into account.

What if I'm already running the promotional material?
The Executive recommends that advice is sought before running advertising material.  Changes to promotions can be costly and a running campaign will not stop an investigation from the PhonepayPlus Investigations team.

Can you advise me on the content of the service?
Yes, we often check scripts for services in addition to checking the promotional material.

Will seeking compliance advice stop me breaching the PhonepayPlus Code of Practice?
The advice provided by the PhonepayPlus Executive is not binding on the Board, however, the Executive will be able to advise you on potential breaches and previous cases which have raised similar issues.  If breaches of the PhonepayPlus Code of Practice are raised any advice given will be taken into account by the PhonepayPlus board.

Can PhonepayPlus advise me on the legality of my promotional material?
PhonepayPlus is not a legal entity and therefore not able to advise on matters of legality. Whenever there is an issue of legality service providers are directed to seek their own expert legal advice for example, competition legality.

What are the qualifications of the compliance team members?
A wide knowledge of the PhonepayPlus Code of Practice, previous cases and current issues.  Team members are fully trained to understand the PhonepayPlus Code of Practice and the reasoning's behind the paragraphs.

Will my proposed promotional material and/or service remain confidential?
PhonepayPlus is bound by confidentiality and data protection laws and therefore any information supplied to PhonepayPlus will be kept in confidence.  Please see paragraph 1.5 of the PhonepayPlus Code of Practice for further information.
